Terms & Conditions
1. Acceptance of Terms
These Terms of Use govern access to and use of the Datta Vani app and related services by users. By creating an account, accepting these Terms, accepting any product-specific terms, pricing page, subscription screen, purchase flow or other commercial terms presented to you, providing parental consent, or allowing a child to use the app, you confirm that you are the parent or legal guardian of the child using the app, or otherwise have legal authority to provide consent; you agree to these Terms and any applicable product-specific terms; you acknowledge the Privacy Policy; and you consent to your child or ward’s use of the app in accordance with these documents.
2. About Datta Vani and Ask Tataji AI Interaction
Datta Vani is a child-focused devotional, spiritual, and educational learning app (“Datta Vani” or “app” or “services”). It provides access to selected content, stories, lessons, quizzes, and the Ask Tataji AI chatbot feature, including AI-generated responses based on approved content sources associated with Tataji’s teachings, books, speeches, stories, and related materials. The app is designed for learning, inspiration, welfare, upliftment and devotional engagement.
The Ask Tataji AI feature uses artificial intelligence. When a child interacts with the chatbot, avatar, audio or video features, the child is interacting with AI-generated content, not a human being. AI-generated content may be inaccurate, incomplete, delayed, unavailable, or inappropriate for a particular situation.
3. Parent Account, Eligibility and Responsibility
3.1 Parents and legal guardians are responsible for:
(i) creating and managing the account, providing accurate parent and child profile information, reviewing and accepting the Privacy Policy and consent notices, supervising the child’s use of the app, managing purchases, credits, subscriptions and limits, selecting appropriate profile names, ensuring that children do not submit private or sensitive information, and contacting us with questions, deletion requests, withdrawal requests, or concerns.
(ii) ensuring that their wards or children do not use the app in a way that is intended to misuse, manipulate, distort, interfere with, or degrade the platform, its algorithm, its outputs, or the integrity of the teachings and materials. This includes repeated, automated, abusive, misleading, or bad-faith prompts or interactions designed to influence, confuse, exploit, or distort the app’s responses.
(iii) ensuring that their wards or children do not copy, reproduce, distribute, modify, scrape, extract, compile, or use the content from the app for any other purpose, including creating, training, testing, improving, or validating any dataset, AI system, machine learning model, or similar technology, whether for personal, public, research, or commercial use, unless prior written approval has been obtained from Yoga Sangeeta, Inc.
The teachings and materials should be approached with sincerity, respect, and care, and should be used in a manner consistent with the app’s purpose. Nothing in these Terms is intended to prevent users from asking genuine questions, reflecting on the teachings, or engaging with the content responsibly.
3.2 You must be at least 18 years old and be the child’s parent or legal guardian, or otherwise have legal authority to provide consent on the child’s behalf, to create and manage an account or child profile for a child on Datta Vani.
3.3 Datta Vani is not a substitute for parental supervision, judgment, guidance, or involvement. The service is designed for use by children only under the oversight of a parent or legal guardian and should not be used by a child without such oversight.
4. Child Profiles and Profile Information
A parent or legal guardian may create one or more child profiles. A child profile may include profile name, age, city/state/country location, avatar selection, app progress, usage limits, scores, rewards, leaderboard information, and other app-related information. Parents should avoid using a child’s full legal name, school name, exact location, phone number, handle, or other identifying information as the profile name, especially because profile names may appear in leaderboards or other visible areas of the app.
5. Parental Consent and Consequences of Withdrawal
Datta Vani uses a bundled parental-consent model for the child-facing app experience. Your parental consent covers the processing necessary to create, maintain, manage and operate the child profile and provide the app, including Ask Tataji AI responses, lessons, quizzes, progress tracking, gamification, rewards, leaderboards, safety filters, caching, analytics, diagnostics, observability, purchases or credits where applicable, service-provider processing, and related app functionality.
Datta Vani cannot currently provide separate consent choices for each child-facing feature. If required consent is not provided, or if consent is later withdrawn, we may disable the relevant child profile and the child may lose access to the app, including gamification, leaderboards, progress, scores, rewards, chatbot history, audio/video features and other related functionality. Withdrawal of consent does not necessarily require immediate deletion of all data already processed by us, and some data may be retained where permitted or required for legal, security, accounting, audit, dispute-resolution, fraud-prevention, backup, de-identification, de-linking, compliance or other legitimate purposes described in the Privacy Policy. If a parent later gives consent again while the relevant child profile data remains available to us, we may, depending on the timeframe, reactivate the existing child profile rather than requiring a new profile to be created.
6. AI Chatbot and AI-Generated Content
The Ask Tataji chatbot uses artificial intelligence. AI-generated responses may be based on approved content sources, including selected teachings, books, stories, transcripts, devotional content, educational content, and related knowledge materials.
AI-generated content may be incomplete, inaccurate, delayed, unavailable or inappropriate for a particular situation. The app may use safety filters, guardrails, caching, retrieval, re-ranking and other systems to improve responses, but we do not guarantee that every AI-generated response will be error-free.
AI-generated responses are provided for educational, devotional, inspirational, welfare, upliftment and informational purposes only.
7. Not Professional, Emergency, Therapy or Crisis Advice
Datta Vani and the Ask Tataji AI feature are not an emergency service, crisis line, therapy service, counselling service, mental health service, medical service, legal service, financial service, or child protection reporting service. Parents should not rely on Datta Vani or Ask Tataji to monitor, detect, escalate, notify, or respond to serious safety issues.
Datta Vani and the Ask Tataji AI feature do not provide medical advice, mental health advice, therapy, counselling, legal advice, financial advice, emergency services, crisis intervention, or child protection reporting services. If a child is in danger, feels unsafe, may harm themselves or others, or needs urgent help, the child should immediately speak to a parent, guardian, teacher, trusted adult, or emergency service.
8. No Private or Sensitive Information in Chatbot
You agree to instruct your child and to remind your child from time to time not to submit private or sensitive information into the app, including full legal names, addresses, school names, phone numbers, passwords, family secrets, health information, emergency information, or private information about other people. If a child includes such information in a question, it may be processed as part of the AI service unless blocked, redacted, deleted or de-linked through an applicable process.
9. Child Safety and Serious Safety Responses
If a child is unsafe, in danger, very sad, considering self-harm, being harmed by another person, or facing an emergency, the child should speak immediately to a parent, guardian, teacher, trusted adult, or emergency service.
For prompts submitted to Ask Tataji and identified by the app as serious safety prompts, Ask Tataji is intended to provide a serious-safety response directing the child to a parent, guardian, teacher, trusted adult, or emergency services where urgent help is needed. Datta Vani and Ask Tataji are not emergency services and do not guarantee live monitoring, escalation, parent notification, human review, or emergency response for any message submitted through the app.
10. Child Safety by Design and Feature Limits
Datta Vani aims to support the safety, privacy, and well-being of children through reasonable product-design, content, privacy, and safety measures.
Datta Vani aims to avoid design practices that are intended to pressure children to spend more time on the app, share more information than is necessary, or make choices they would not otherwise make.
Datta Vani may limit, modify, suspend, or remove features that it determines may create inappropriate risk for children, including features that may encourage overuse, unnecessary sharing, emotional pressure, unsafe interactions, communications, or child-safety concerns.
If you believe any feature of Datta Vani is confusing, manipulative, unsafe, or not age-appropriate for your child, you should discontinue your child’s use of that feature and contact us using the contact information provided in the app, these Terms or Privacy Policy.
11. Design, Dark Patterns, and User Choices
Datta Vani strives to present choices related to privacy, notifications, communications, child profiles, parental consent, purchases, account settings, and parental controls in a clear and balanced manner.
Datta Vani aims to avoid design practices that are deceptive, confusing, or that unduly pressure users to select options that are less protective of privacy, safety, or parental control.
Datta Vani may modify, restrict, or remove features, prompts, settings, notifications, recommendations, or interface designs if it determines that changes are appropriate to support child safety, user trust, accessibility, legal compliance, or applicable regulatory guidance related to dark patterns or unfair or deceptive practices.
If you believe any part of Datta Vani uses design elements that are confusing, misleading, manipulative, or inappropriate for children, you should discontinue use of that feature or the service overall, and contact us.
12. Acceptable Use
You and your child must not submit unlawful, harmful, abusive, sexually explicit, violent, harassing, hateful, exploitative, or privacy-invasive content.
You and your child must not attempt to obtain medical, legal, financial, emergency, crisis, therapeutic, counselling, or child-protection advice from the app.
You and your child must not submit private information about other people without permission, impersonate another person, interfere with the app’s operation or security, bypass usage limits or parent controls, reverse engineer the app, scrape content, misuse AI outputs, or use the app for commercial purposes without permission.
You and your child must not use Datta Vani in any way that exploits, harms, threatens, harasses, manipulates, or endangers minors or any other person, or that submits, generates, distributes, requests, or encourages content that is abusive, exploitative, sexually inappropriate, violent, self-harm-related, discriminatory, unlawful, or otherwise unsafe.
13. Safety, Abuse, and Misuse Reporting
If you become aware of any content, user behavior, feature, communication, AI-generated response, or technical issue that could present a risk to a child, you should report it through any reporting tools provided in the app or through the contact information in these Terms or the app’s Privacy Policy.
Datta Vani may review, restrict, remove, preserve, or report content or activity where it reasonably believes that doing so is necessary to protect children, users, the app, or the public.
Datta Vani may cooperate with law enforcement, child protection organizations, regulators, service providers, or other authorities where it believes that a report, investigation, or response is appropriate and consistent with applicable law.
14. Accessibility
Datta Vani is committed to making the app, website, onboarding flow, notices, learning materials, and related digital content reasonably accessible to users with disabilities, consistent with applicable law and prevailing technical standards for web and mobile accessibility.
Datta Vani’s accessibility efforts may include improving navigation, readability, compatibility with assistive technologies, access to core educational content, and access to legal notices and account controls.
If you experience difficulty accessing any part of Datta Vani, the website, legal notices, onboarding materials, videos, learning content, or other digital content, or if you need information in an alternative format, you should contact us using the contact information provided in the app or Privacy Policy.
Datta Vani will review accessibility requests and take reasonable steps to address accessibility issues where feasible and required by applicable law.
15. Lessons, Quizzes, Scores, Rewards, and Leaderboards
The app may include lessons, stories, quizzes, scores, coins, points, XP, streaks, bonus quests, super bonus quests, progress tracking, rewards and leaderboards. Scores, rewards, streaks and leaderboards are intended to encourage learning and engagement. They do not represent any official academic, religious, psychological, professional, behavioural, or developmental assessment.
Leaderboards may display profile names, avatars, scores, rankings, XP, coins/points and location-based groupings such as country, state or city. Leaderboard participation is currently part of the child-facing app experience and cannot be separately opted out of. Parents should choose profile names carefully and avoid using full legal names or other identifying information.
16. Purchases, Subscriptions, Packs, and Credits
The app may offer paid features, paid tiers, subscriptions, packs, audio responses, video responses, higher usage limits or other paid functionality. Text responses may also be subject to a paid tier or usage limit depending on the product configuration. Purchases are intended to be made by parents or legal guardians. Children should not make purchases directly. The parent PIN, parent dashboard, app-store account authentication, payment-provider authentication or other purchase controls may be required to access purchase functionality.
Product plans, prices, included features, usage limits, trial periods, billing periods, renewal rules, payment methods, cancellation options, taxes, currency, regional availability and other commercial terms may be shown on a product page, pricing page, subscription screen, purchase flow, app-store listing or other product-specific terms page. Those product-specific terms form part of these Terms when accepted or when the relevant purchase, subscription, pack or paid feature is used. We may update product-specific terms, plan names, pricing, feature descriptions and commercial options from time to time without restating the full text of these Terms, provided that any changes will apply in accordance with applicable law, any required notice, and any rules of the relevant app store or payment provider.
Purchases may be processed through Apple, Google, Stripe, RevenueCat or another app-store, billing or payment provider. Those providers may apply their own terms, billing rules, refund rules, payment policies, cancellation processes, parental controls, external-link rules and regional requirements. For purchases made through Apple or Google, refunds and cancellation requests may need to be handled through the applicable Apple or Google process. For purchases made through Stripe, RevenueCat or another payment provider, in-app subscription management, cancellation, renewal, customer-support and payment-status information may be made available where technically supported.
Unless a product-specific term states otherwise, cancelling a subscription stops future renewal, but paid access may continue until the end of the then-current billing period. We do not provide prorated refunds for partial billing periods unless required by law, required by Apple, Google or another payment provider, expressly stated at the time of purchase, or approved by us on a case-by-case basis.
If a parent deletes an account or child profile, any active subscription or paid access may also be cancelled or disabled where technically supported by the relevant app store, billing provider or payment provider. If automatic cancellation is not technically supported or is not controlled by us, the parent may need to cancel the subscription separately through Apple, Google, Stripe, RevenueCat or the applicable payment provider. The app may display warnings or instructions before account deletion where deletion may affect paid access, renewal, subscriptions, packs, credits, or other purchase-related functionality.
The app may in future offer credits, packs or other separately purchased usage units. Unless product-specific terms are presented for those features, these Terms do not currently commit to any specific credit expiry, refund, rollover or reinstatement rules for future audio, video or similar paid usage features. Any such rules should be reviewed and presented before those features are released or made available for purchase.
17. Soft Launch and MVP Status
If you access Datta Vani during a beta, invite-only, limited-release or soft-launch period, you understand that the app may still be under development; features may change; some features may be incomplete or unavailable; AI responses may be imperfect; performance may vary; and data collected during the soft launch may be used to operate, improve and support the production version unless deleted in accordance with our Privacy Policy.
18. Service Providers
The app depends on service providers, including AI, hosting, database, storage, analytics, diagnostics, crash reporting, observability, notifications, authentication, payment, app-store and support providers. Use of the app may involve processing by those providers as described in the Privacy Policy.
19. No Advertising Use
Datta Vani does not sell children’s personal information or use children’s personal information for third-party behavioural advertising, cross-context behavioural advertising, or targeted advertising directed at children.
20. Intellectual Property and User Submissions
The app, software, design, text, graphics, audio, video, stories, lessons, quizzes, content structure, trademarks, logos, and other materials are owned by or licensed to Yoga Sangeeta, Inc. or its licensors. You may use the app only for personal, family, non-commercial use unless we give prior written permission. The content and materials on this platform are provided for personal spiritual study, reflection, and educational use only.
Questions, prompts, feedback, support messages and other content submitted through the app may be processed to provide the app, generate responses, improve safety, improve performance, cache responses, provide support, and improve current and future features, as described in the Privacy Policy.
21. Deletion, Withdrawal, Suspension, and Termination
Parents may request deletion of a child profile, withdraw parental consent, delete an account, or cancel paid access where supported. Withdrawal of consent (also called consent revocation), deletion of a child profile, account deletion or cancellation may affect progress, scores, rewards, leaderboards, chatbot history, generated audio/video, credits linked to app functionality, subscriptions, packs, paid access and access to app features. Consent withdrawal will ordinarily disable the relevant child profile from the normal child-facing app experience. A deletion request will ordinarily place the relevant child profile in a deletion-pending state for up to 30 days, during which the profile may be inactive, inaccessible to the child and not visible in the normal app experience, unless a shorter period is required by law or we determine that immediate deletion is appropriate. After that period, child profile data will be deleted or de-linked from active systems, subject to limited retention in backups, logs, transaction records, security records, de-identified or de-linked records, legal/accounting records, audit records, dispute-resolution records, fraud-prevention records, compliance records or other records described in the Privacy Policy.
We may suspend, restrict, disable or terminate access if these Terms are violated, the app is misused, required consent is withdrawn, payment fails, a subscription or paid entitlement ends, a payment is disputed or reversed, or suspension, restriction, disabling or termination is necessary for safety, security, legal, compliance, operational or payment-related reasons. If consent is later restored or a parent returns after withdrawing consent, we may reactivate a previously disabled child profile where the relevant data remains available to us and reactivation is lawful, technically feasible and consistent with the Privacy Policy.
22. No Warranties, No Absolute Safety Guarantee, and Limitation of Liability
We do not guarantee that children will never encounter content, AI-generated responses, technical issues, or situations that a parent or guardian may consider inappropriate, inaccurate, upsetting, or harmful.
The app is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we do not make warranties that the app will be error-free, that AI responses will be accurate or complete, that the app will meet every need or expectation, or that the app will be uninterrupted or always available.
To the fullest extent permitted by law, Yoga Sangeeta, Inc. and its officers, directors, volunteers, employees, contractors, service providers and affiliates will not be liable for indirect, incidental, consequential, special, punitive or exemplary damages arising from or related to use of the app. Nothing in these Terms limits liability where it cannot legally be limited.
23. Governing Law and Mandatory Rights
These Terms and any dispute, claim, action, or proceeding arising out of or relating to these Terms, the Datta Vani app, or any related services will be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to conflict-of-law principles that would require the application of the laws of another jurisdiction.
Nothing in these Terms is intended to limit, waive, exclude, or restrict any consumer protection, children’s privacy, data protection, parental rights, or other rights that cannot lawfully be limited, waived, excluded, or restricted under applicable law. To the extent any provision of these Terms is found to be unenforceable as applied to a particular user, claim, or jurisdiction, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.
Subject to the mandatory rights described above, the parties agree that any dispute, claim, action, or proceeding arising out of or relating to these Terms, the Datta Vani app, or any related services must be brought exclusively in the state courts located in Burlington, New Jersey, or, if federal jurisdiction exists, in the United States District Court for the District of New Jersey. Each party consents to the personal jurisdiction of those courts and waives any objection to venue or forum, including any objection based on inconvenience, to the fullest extent permitted by law.
24. Changes to These Terms and Contact
We may update these Terms from time to time. We may also update product-specific terms, pricing pages, subscription screens, purchase flows, plan descriptions and commercial options from time to time. If we make material changes to these Terms, or where applicable to product-specific terms, we will provide notice to parents through the app, parent dashboard, the email address used for sign-up, the relevant product or purchase screen, or another appropriate method. Where required by applicable law, including children’s privacy laws, we will obtain renewed parental consent before applying material changes to the collection, use, or disclosure of a child’s personal information.
